Ordinance no. 89-019 of July 31, 1989 and its implementing decrees are currently the texts establishing a system for the protection of Industrial Property in Madagascar. However, given the evolution of technology and the predominant place given to Industrial Property rights in society and in economic exchanges, the actors of economic life (economic groups, Industrial Property Representatives, etc.) under the supervision of the Ministry and the National Office, set about revising this Ordinance nearly 10 years ago to produce a law that would be more in line with the needs and practices of its users. Following this work, a draft was created in 2017, but the text was never published in the Journal Officiel after the vote in the Assembly. This year, 2024, higher authorities are showing willingness to resume work on this draft. Civil society will be called upon to participate, and the Association des Représentants en Propriété Industrielle (A.R.P.I. Madagascar), of which LEX MERCAT is a member, intends to contribute its expertise.
